Local court orders police to investigate 'alleged custodial killing' | | | Early Times Report
banihal, Mar 4: Following instructions of Principal District and Sessions Judge Ramban on alleged custodial death of a youth Aramdhak of Khari tehsil in district Ramban, the Judicial magistrate First Class JMIC Banihal directed SHO Banihal to further investigate the matter. As per case, 20 years old deceased Mohammad Ramzan s/o Gafar Lone of Armdhak was picked up by Police post Kari on 15 May 2014 regarding some investigating and after released the deceased felt some pains and immediately was shifted to District Hospital Ramban from where he was shifted to EH Banihal. Thereafter he was referred to SMHS Srinagar and then to SKIMS Srinagar where he breathed his last on 6 June 2014. After the death of Mohammad Ramzan his uncle Abdul Satar Lone and others presented an application before the the court of JMIC Banihal for the registration of an FIR against the then police post incharge Khari SI Younis and other police staff posted in Police post khari. Initially Court is of opinion that the allegations are very serious in nature, after receiving the inquiry report the JMIC Banihal dismissed the application of the applicant on 10-06-2015. Later the petitioner filed the revision petition before the District and Sessions Judge Ramban on 10-10-2015. The District and Sessions Judge Ramban directed to seek the await of report of queries and inquest report and then proceed under law. After the fresh investigations the JMIC Banihal have received the medical report postmortem which has given by medical board of doctors from Srinagar. The court ordered that from the perusal of these quires now it is clear that the deceased was not suffering by any kind of disease whatsoever. Court said that the inquest proceeding under Section 174 CrPC is also pending for the last one and half year. JMIC Banihal observed that this court on various times has given direction to inquiry officer to provide the present status proceeding under section 174 crpc, but the inquiry officer and SHO Police Station Banihal does not provide any genuine reason for the delay on completion of proceedings under section 174 CrPC. Court directed to SHO Banihal to investigate the matter under law and also ordered the instant application is disposed of and shall become part of the main challan as an when produced. |
