HC directs revenue secy to file ATR or appear in person

Jammu, Mar 28 : A high court division bench of Justice Mohammad Yaqoob Mir and Justice B S Walia today took serious note of non-filing of Action Taken Report (ATR) by the revenue secreatry against delinquent revenue officials indicted by then divisional commissioner Shantmanu in the alleged Chatha-Sunjawan land scam.
The court had earlier directed the revenue secretary to file ATR vide its February 29, 2016 order.
The bench, after hearing the two sides, directed the revenue secretary to file ATR within two weeks, failing which he would appear in person on the next date of hearing.
The bench also directed the senior AAG to file the updated status of verification being carried out by crime branch (CB) on the reference made by GAD regarding encroachment of government land at Chatha-Sunjwan.
The CB probe revealed that land under khasra No 1442 comprising 20 kanals 12 marlas had been shown as proprietary land belonging to Bachitar Singh vide Khewat No 19 khata No 406. It also revealed that this land had also been reflected as state land vide khewat No 85 Khata No 646. The record of Misal Haqiat to this effect has been perused and its copy has also been obtained which corroborates to the factual position of the status of the land, according to the CB probe. The status report said verification was still under progress and more persons acquainted with the matter had been summoned for questioning besides some more records were to be collected to ascertain as to how and why the nature of land with regard to the ownership was changed so that the instant verification could be concluded on merits at the earliest.
The bench directed CB to come up with a fresh status report with regard to verification and also directed revenue secreatry to file ATR within two weeks or appear in person. (JNF)
