Jammu, Mar 30: High court judge Mohammad Yaqoob Mir today gave a directive on the seniority of a medico. It came in a petition filed by Dr Mohammad Riaz, seeking quashment of government order No 201-HME of April 15, 2014 whereby Dr Zahoor was deemed to have joined the post of lecturer (Surgery) on notional basis from July 11, 2008, ie date of order of appointment. The period from July 11, 2008 to August 1, 2009 has been directed to count towards his seniority. Justice Mohammad Yaqoob Mir, after hearing the counsels, held that from the date of order of appointment and from the date of joining, Dr Zahoor was senior to the petitioner. While applying the law as quoted above, the length of service as was reckonable from the date of appointment and for the period Dr Zahoor had not joined, pecuniary benefits were granted as was mentioned in the government order No 605-HME of October 22, 2014 granting extension of time for joining. With these observations, the court dismissed the petition. (JNF) |
