Shoddy probe leads to acquittal in NDPS case | | | Early Times Report JAMMU, May 13: 1st additional sessions judge, Jammu, M A Chowdhary today acquitted two alleged NDPS smugglers after prosecution failed to prove the case against them. Three kilograms of charas was alleged to have been recovered by police from the possession of Mohammad Ashraf and Rakesh Giri on June 29, 2011. The alleged recovery was made by police on a tip-off, police sources said. The police had specific inputs that the duo had allegedly been smuggling cannabis from Kashmir to Jammu in league with some persons who were operating here in the guise of sadhus. The judge, after hearing the counsel for the accused, observed that recovery was not in accordance with procedure as neither search warrant was obtained no some senior officer supervised the operation even as the recovery was claimed to be have been made in the evening by a havaldar. With these observations, the court acquitted both the accused from the charges as the prosecution falied to prove its case. —(JNF) |
