HC directs expeditious trial in Gulmarg land scam

Srinagar, Dec 21: The state high court has directed trial court to expeditiously proceed into the matter pertaining to Gulmarg land scam while clarifying that not all but only those constructions be stopped which are being raised without permission from the competent authority.
On last date of hearing, the court had received record from trial court with regard to the scam which came to light in 2009 after Vigilance Organisation, Kashmir (VOK), had registered an FIR against some top officers and a few hoteliers of Kashmir for alleged grant of ownership of state land duly transferred to Gulmarg Development Authority (GDA).
"Perusal of the record reveals that the trial judge has observed that he will proceed in the matter on the basis of material produced before him by the investigating agency," said a division bench headed by Justice Muzaffar Hussain Atta, directing registry to return record to the trial court forthwith.
Meanwhile, the court-appointed committee comprising Deputy Commissioner and Senior Superintendant of Police, Baramulla submitted a report, stating therein that immediately after receipt of court order of December 2, 2016, they visited Gulmarg and they did not find any illegal construction going on within areas of the tourist place.
They also stated that directions had been issued to GDA officials, SDPO and concerned SHO to ensure that no illegal construction was carried out at the tourist place. The committee members also submitted that nakas had been established at specific locations in Gulmag to prevent entry of any material for construction purposes.
"We make it clear that only those constructional activities are to be stopped which are being raised without grant of permission by the competent authority and all constructional material, which is being transported illegally, has to be seized by the concerned authorities," the court said.
"The competent statutory authority has to consider the matter in terms of statute and merit and pass order either for grant of permission for renovation, reconstruction or declining the same. All those persons, who will file fresh applications shall deposit the requisite fee before the Registry of the court within one week from the date applications are filed with GDA CEO," the court said.
