HC notice in contempt petition on implementation of Shetty Commission | | | Early Times Report
jammu, Dec 21 : In a contempt petition filed by judicial employees of subordinate courts regarding implementation of a division bench judgement in which the Chief Secreatry was directed to implement Shetty Commission, a high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today issued notice to the senior additional advocate general for appearance on December 29. The employees had sought implementation of Shetty Commission Report as far as its recommendations pertaining to the ministerial staff working in subordinate courts of the state are concerned. The bench, after hearing the two sides, directed the chief secretary and others to implement the Shetty Commission recommendations with effect from April 1, 2003 which was agreed to be implemented by the chief minister and as per the March 16, 2015 Supreme Court directions within three months. According to the petitioners, the court had administratively taken up the matter with the state government for the implementation of Shetty Pay Commission recommendations in a meeting of then Chief Justice of high court with then Chief Minister on April 2, 2008 on this aspect and after deliberations, it was agreed by the government to implement the recommendations in a phased manner after ascertaining the financial implications. A Monitoring committee was constituted under the chairmanship of chief secretary of which the high court Registrar General was a member. The bench observed that it 'is evident that in spite of the receipt of benefits under 6th Pay Commission, the employees of subordinate courts in all states are eligible to get the benefits as recommended by Shetty Commission. Hence the state cannot deny the benefits which were ordered to be extended to the ministerial staff of the subordinate courts. (JNF) |
