Govt not taking important issues seriously: HC | | | ETT scam

Srinagar, Dec 24: Coming down heavily on the state government over its handling of "important and sensitive" issues pertaining to education sector, the J&K High Court has directed Commissioner Secretary, Education Department, to file an affidavit, indicating proposed modification to be incorporated in the education rules of 2010. Hearing a Public Interest Litigation, a division bench of Justices Muzaffar Hussain Attar and Ali Mohammad Magrey also directed IGP Crime Branch to file status report before next date of hearing about the steps taken for completion of investigation in pending cases regarding the scam into Elementary Teachers Training (ETT). The division bench's remarks on government followed perusal of a status report filed by the Under Secretary to Government School Education Department in reference to court's order on November 25. "The status report would show that the respondents are not taking important and sensitive issues, pertaining to the education sector of the State, seriously" the court said, referring to follow-up action on the recommendations of a committee ordered to be constituted by it. "The committee, which was constituted in the year 2015, in pursuance to court orders, though convened its meetings on September 18,2015, October 1,2015 and February 9,2016 and thereafter sent its recommendations vide communication dated December 7,2015 and February 11,2016, no decision was taken till the court reminded the authorities on November 25, 2016 as to what steps were taken by the authorities in terms of communication dated February 11, 2016. It is thereafter that a meeting was convened," the court said. The status report stated that recommendations forwarded by the committee were discussed in the meeting threadbare and that the committee has asked for some modifications to be incorporated in the J&K Education Department Rules 2010 notified SRO 123 dated March 18, 2010. "What modifications are required to be incorporated in the rules of 2010, have not been delineated in the status report," the court observed and directed commissioner secretary to government education department to file affidavit indicating therein as to what are the proposed modification, which are to be incorporated in the rules of 2010 and which type of administrative orders are required to be passed. "The affidavit be filed before the next date of hearing," it said. The direction to the IGP Crime branch followed perusal of a status report filed by him in which some details have been given about the conduct of investigation and filing of report u/s 173 CRPC before the court of competent jurisdiction. The IGP Crime Branch Jammu state that charge-sheets for the sessions 2003-20005, 2004-20006, 2005-20007 & 2006-2008 in FIR 36/2013 u/s 420,468 , 471, 120-B RPC read with section 5(2) of Prevention of Corruption Act 2006 have already been produced before the Special Judge of Anti-corruption Jammu under four challans. The status report also revealed that investigation in respect of session 2007-2009 has been finalized and charge sheet has been produced before the court recently on December 13 against 7 promoters of ETT institutes. In addition to this, the IGP Crime Branch stated the examination records pertaining to session 2008-2010 has revealed that two batches of ETT courses in 2008-2010 (General) and 2008-2010 (court cases) were started by the BOSE authorities and out of 60 ETT institutes established by the promoters in the sessions, records in respect of 48 ETT institutes have been scrutinized and examination of records in respect of remaining 12 ETTs is going on. After completion of examination of the records of institutes, investigation of session 2008-2010 will be concluded, the IGP's report reads. "The crime branch has yet to do many things in bringing the matter to its logical conclusion," the court said and expressed hope that the investigation in respect of other allegations will also be concluded at the earliest. It directed the IGP Crime Branch to file status to file status report before next date of hearing in the PIL about the steps taken for completion of investigation in respect of other cases as well. An inquiry conducted by the Board of School Education (BOSE) into the training course by the ETT colleges has already described it a "big scandal run by mafia in league with the top brass in the BOSE." The investigators arrested some officials of the BOSE including its former chairman in connection with the case. They were later released on bail. |
