Jammu, Dec 24 : Principal sessions judge, Kathua, Vinod Chatterji Koul has upheld the two years impriosnmnet awarded by trial court in an acid attack case. Due to some old enemity, one Sonu was alleged to have thrown acid on PHE employee Sadhu Ram near Basohli in Kathua on August 17, 2013 as a result of his he had sustained severe burns. He was shifted to the Basohli government hospital by his wife Krishna Devi. The judge, after hearing both the sides, said it was established beyond doubt that the accused had thrown acid on the complainant, causing him serious injuries. The accused waylaid the victim before throwing acid on him with a bucket, which was recovered on his disclosure along with a bottle containing small quantity of acid, he observed. "The prosecution has proved the charge against the accused beyond any reasonable doubt. He is, thus, found guilty of offences punishable under sections 341 and 326 of RPC. The trial court has convicted and sentenced him to undergo simple imprisonment for one month and and fined him Rs 500 for offence punishable under section 341 of RPC and simple imprisonment for two years and fined him Rs 5,000 for offence punishable under section 326 of RPC. In default of payment of fine, he shall further undergo simple imprisonment for one month. However, both the sentences have been directed to run concurrently," the court said. "From the discussion made hereinabove, it is held that the trial court has properly appreciated the evidence on record and rightly convicted and sentenced the for the commission of offences punishable under sections 341 and 326 of RPC," the court observed.
