How Govt ignores court orders | | | Early Times Report
Jammu, Dec 24: The government of Jammu and Kashmir has been seen as non-serious towards implementation of courtorders. In a latest case titled "Mansoor Ahmed Dool Vs State of J&K & Others", after delay of more than three months, the counsel of the aggrieved petitioner sent a legal notice to Director Health Services Jammu regarding the implementation/compliance of the judgment passed by the High Court in SWP No. 2013/2016 22-09-2016. The petitioner Mansoor Ahmed Doolwal was working as Senior Assistant in the Health Department and was posted at Kishtwar before he was transferred to Primary Health Center Dachhan where no post of Senior Assistant stands sanction. The petitioner was transferred by the government vide order No. DHSJ/Es-4/2443 dated 25-5-2016. On the same day the petitioner approached the Chief Medical Officer Kishtwar with the representation highlighting his medical condition, besides also about non-availability of post. The CMO Kishtwar referred his case to Director Health Services Jammu for considering the revocation of his order on various grounds including his poor health. But Director Health Services Jammu did not revoke his transfer, forcing the petitioner to approach the High Court. After hearing the matter, Justice Ramalingam SudaKar directed the respondent to consider the representation of the petitioner within four weeks. But the government failed to implement the court order, forcing the petitioner's counsel to send a legal notice to the respondents. Later, the Director Health Service Jammu issued an order (No. DHSJ/Legal?10059-60, dated 20-12-2016) wherein the petitioner was posted at District Tuberculosis Center (DTC) Kishtwar with the direction that he will withdraw his salaries against any equivalent or higher grade post in DTC Kishtwar. It is pertinent to mention that the judgments in several cases including in the case of seniority of KAS, KPS as well as seniority in several other government departments are lingered on various grounds, making the petitioners to suffer, besides leading to collapse of functioning of administrative functioning at various levels. |
