Law Commission proposal gathering dust before cabinet
Four months on, Govt fails to give nod to its own move

Jammu, Aug 11: A mere nod by the cabinet of PDP-BJP alliance that would have paved way for setting up of a separate Law Commission in the state is in waiting for over four months now, thanks to lackadaisical approach of the government which is delaying the move. The step as and when gets materialized would lessen the burden of the already overloaded Law department but more than that it would enable refreshing the old and outdated provisions of various vital laws besides modifying the existing laws as mandated by the government.
Sources said the proposal for setting up of Law Commission was formally sent to cabinet in the meeting scheduled sometime in May, but it was deferred a couple of times by the cabinet for one or the other reason. Even though the move was first initiated during previous coalition governments, it never got fructified till the existing PDP-BJP alliance gave a formal shape to it. However, it is of no use as there are many formalities before it gets in functional mode, clearance by the cabinet being the first step in that direction, sources said. It lies pending with the cabinet and could not get further fillip as no cabinet meeting has taken place for over two months.
Sources further said that setting up of Law Commission has assumed much importance, rather a need as there are many laws , few of them from the time of Dogra rules which are very important but have become obsolete and need certain modifications to make them relevant and practicable in present times. It is the job of the Law Commission to get such laws updated and refreshed in terms of making changes as per the requirements, said the sources adding that the Central Law Commission is very much in place but since it has no jurisdiction in the state, its functioning is meaningless for J&K.
The Central Law Commission can neither recommend nor effect any changes, nor are the central laws directly applicable in the state, notwithstanding the fact that this Commission is permanent and quite effective and useful for all other states across the country.
The Law department in the state has not been able to pay attention towards the work of examining the issues which Law Commission will now take up as it is already overburdened with day to day works of the government, said the sources. However, it will take some time even if the cabinet gives nod to it as it will require appointment of chairman and members for the Commission to make it run the work, sources added.
