HC stays pharmacist's transfer order | The order was issued at the behest of Health Minister | | Early Times Report
jammu, Aug 20: High court judge Tashi Rabstan today stayed the transfer order of a junior pharmacist. The court directive came in a petition filed by Khem Raj, a junior pharmacist, seeking quashment of the impugned order No CMOU/Pharmacist/2015/1717-20. A notice was issued notice to the health minister and others, returnable within four weeks. Justice Rabstan, after hearing the petitioner's counsels, stayed the impugned order of May 25, 2015 whereby the petitioner had been deployed for duties at the district hospital, Udhampur. The counsels argued that transfers can't be issued with malafide intentions or for other extraneous and political considerations as that would be violative of the civil service regulations. They said the transfer order issued barely two months after the last posting of the petitioner and that too on the directions of the heath minister was violative of service laws and in contravention of various judgements passed by the high court on the subject in the past. Besides it was a non speaking order which didn't spell out the interest of administration involved in the said transfer except stating the fact that it was the desire of the minister.(JNF) |
