SMC sleeps over Lal Nagar land encroachment

Srinagar Sept 12: Notwithstanding court orders for dismantling an illegal structure at Pal Mohalla Lal Nagar Chanpora, the Srinagar Municipal Corporation (SMC) is reluctant to act thus causing inconvenience to the people.
Just 10 years ago there used to be an irrigation canal in Pal Mohalla Lal Nagar but as the paddy land in and around , Lal Nagar and Chanpora area was converted into residential colonies in 1990's , the irrigation canal dried up and became useless for the people. The dried canal ultimately became a link road and locals started using it. Few years ago UEED authorities even constructed a big drain in the area which flows under this erstwhile canal. But some locals have now encroached upon this canal by erecting iron bars etc on this link road at Chan Mohalla and Pal Mohalla which has shrinked the link road which happens to be part of the state land (shamilaat) as per revenue records. Information obtained under RTI Act by an aggrieved local resident Bilal Ahmad Najar from concerned R&B division Chadoora and UEED reveals that said land is a state land which has been encroached by a blue eyed family.
"The Srinagar Municipal Corporation (SMC) issued as many as three demolition orders during the last five months but they do not act on the ground and instead facilitated the illegal encroachment and construction on 15 th August recently when there was a strict hartal in whole valley " said Bilal Ahmad Bilal and showed copy of a court order to this correspondent which was issued by Municipal Magistrate Srinagar on 13.8.2015. The order reads :
"Till next date of hearing the non applicants are temporarily restrained from demolishing any legally and validly raised construction. Howover the orders shall not debar the non applicants (SMC) from demolishing any construction raised in violation of master plan , Municipal Laws , Rules, Statutes, high court directions governing the subject"
Bilal says that SMC is not implementing its own order as well as order of the court issued by municipal magistrate Srinagar.
"The municipal magistrate has given clear direction to SMC for demolishing all illegal structures which have come up in violation of municipal laws etc. The encroachment of irrigation canal is also a violation of master plan and the officials of SMC themselves agree to it and they issued three demolition orders in the month of August but these orders are not implemented on ground" Bilal added.
Documents available with Early Times reveal that Tehsildar Chanpora in his report submitted before Deputy Commissioner Srinagar few days back clearly mentioned that area encroached at Pal Mohalla Gulshan Nagar is a "Kah Charai " but the DC office is also not at all acting.
"I can say with authenticity that SMC officials have taken money from the encroacher and that is why they are not acting" said Mohammad Amin a resident of Chanpora.
