Three Education Deptt employees convicted for corruption

Srinagar, Dec 17: The Court of Additional Judge Anti-Corruption Pulwama presided over by Virinder Singh Bhou convicted three government employee working with education department for their involvement in corruption.
The accused have been identified as Mohammad Akbar Dar, Shahaza Akhter and Abdul Aziz Shah who have been booked in a case registered under FIR NO. 105/1997 of Police Station VOK.
Nisar Ahmad Allaqband Public Prosecutor appearing on behalf of Vigilance Organisation submitted the details of the case, the Additional Judge Anti-Corruption Pulwama Virinder Singh Bhou sentenced accused Mohammad Akbar Dar, Shahnaza Akhter and Ab. Aziz Malik to undergo three years imprisonment for the commission of offence under section 5(2) J&K P.C Act and fine of Rs 10,000/- and further imprisonment of one year in default of payment of fine. Court further observed that for conspiring the offence abetted under Section 5 (1)(d) of PC Act read with section 5(2) of PC Act for offence under section 120-B RPC is again convicted and sentenced to undergo simple imprisonment for three years and pay a fine of Rs. 10,000/- and in default of payment of fine accused shall further undergo simple imprisonment for one year.
The brief facts of the case are that case FIR No. 105/97 under section 5(2) J&K Prevention of Corruption Act r/w Section 120-BRPC was registered against the accused in Police Station Vigilance Organization Kashmir in the year 1997. The instant case owes its origin to an enquiry that illegal appointment order in favour of Shahzada Akhter, Mahmooda Banu, Saleema Akhter, Bashir Ahmad Ganai, Shahnaza Akhter, Fayaz Ahmad Shah, Wahida Akhter and Suraya Asaim were fraudulently issued in violation of Recruitment Rules by DEO Pulwama Ali Mohammad Mir and the then Chief Education Officer Haleema Mufti. It was futher revealed that another Chief Education Officer Ab Majid Bhat in connivance with then Dy Commissioner Pulwama yameam Qureshi have made some appointments of Craft Teachers, Laboratory Bearers , peons etc.
After thorough investigation, I/O established Criminal Misconduct in terms of section 5(2) J&K P.C Act under Sections 420,468,120B,204 RPC against the accused persons and after completion of investigation, the charge sheet was produced against the accused persons before the Court of Special Judge Anti-corruption Kashmir by vigilance Organization on 06.03.2003. The Court of Additional Judge Anti-corruption Pulwama found the accused guilty who were convicted accordingly.
