JAMMU, Dec 17: High Court has stayed the order of Director School Education (DSE) Kashmir through which he had canceled the constitution of the managing committee of the DAV Public Secondary School (DAVPSS) Jawahar Nagar, Srinagar.
High Court has issued notice to the DSE Kashmir and asked him to explain in detail reasons for cancelling the constitution of the managing committee of the DAV Secondary School. In a handout issued here today, the management of DAV Public Secondary School, Jawahar Nagar, Srinagar has challenged the allegations of the Director School Education Kashmir recorded in the order no. 2571-DSEK dated 14-10-2015 as malicious propaganda, intolerance and driven by communal passions against the religious minority institute in Srinagar.
They have said that Director School Education has leveled baseless allegations in the said order presumably in order to save his predecessors in the Directorate who had issued the order for closing DAV Magarmal Bagh, Srinagar in 2006 claiming it to be government land and handing it over to land mafia during the period. They have said that DAV properties remained under the Directorate of School Education Kashmir by virtue of the lower court orders from 1990 to 2013.
They have further said that the management of DAV School was invited by the Chief Minister Mufti Mohammed Sayeed on October 14, October 2015 at his residence regarding the School affairs wherein office bearers of the managing committee along with the representative of DAV College Managing Committee, New Delhi ( Parent Body) and Director School Education was also present. A memorandum was handed over to the Chief Minister for conducting a thorough investigation into misuse of the DAV assets including fixed deposit receipts worth more than Rs. 3 crores and other immovable property pertaining to the displaced minority community of Kashmir.
They have alleged that the present Director School Education could not digest this action and unnerved by this development, issued the order no. 2571-DSEK dated 14-10-2015 invalidating the duly approved managing committee on concocted, mischievous and false allegations. After this development, the committee has said that it challenged this order in the High Court where this order was stayed and a notice was issued to the Directorate of School Education (DSE) Kashmir.
The management has alleged that the memorandum presented to Chief Minister on October 14, 2015 has been seemingly ignored. It has further said that DAV Management was restored by High Court order dated October 24, 2011 after proper judicial scrutiny and protracted legal battle from 1990 against the state government and local population. They have added that management was handed over to this approved managing Committee by government on 17-09-2013 incompliance to the High Court orders. Further the management has alleged that it was not allowed to conduct repairs and raising of boundary wall which suffered extensive damage in September 2014 floods with design and ulterior motives by blocking permission and once the permission was granted by Srinagar Municipality on 22-09-2015 after a gap of one year which had forced the management to declare lockout in the school in April 2015 in view of inadequate security and damaged assets. They have further alleged that step by step blockades and harassment are being created by the agencies of the government in order to discourage minorities to take control of their assets and have not paid any attention to the submissions made by management to restore the past glory of these prestigious schools.
