Parliament held to ransom by Opposition
Stampede of National Interests

Disrupting Parliament has now become an easy tool to express anger or displeasure. It is unfortunate that the opposition led by congress has held the Parliament as a hostage and has not allowed the important work of legislation done. Most of the period of winter parliament session has been washed out and now a few days have left before the present session comes to an end and if the present "holding ransom of parliament" continues for some more days, the entire winter session will be washed away with out transacting any business and the opposition will be squarely responsible. But the question is why opposition is not allowing the smooth functioning of the parliament. In a democratic setup and in any democratic country, the opposition has a right to protest against the Govt. for doing anything that is going against the interests of the nation. If that is the reason, then it is OK but the fact of the matter is that they are protesting against the Govt. to protect the interests of individuals who are involved in the National Herald case. Let me analyse the case for the readers of this article. The National Herald Case is the case filed by Dr. Subramanian Swamy against Sonia Gandhi and Rahul Gandhi, their companies and associated persons in a court in Delhi. As per the complaint filed in the court , Indian National Congress granted an interest-free loan of Rs.90 crore to the Associated Journals Limited (AJL), owner of National Herald newspaper. A company "Young Indian" was incorporated in November 2010 with a capital of Rs.5 lakh and it acquired almost all the shareholding of AJL and all its properties.
The (AJL) is an unlisted public company incorporated in 1937, with its registered office at Herald House, New Delhi. Motilal Vora has been the chairman and managing director of AJL since 2002 The Company had incurred losses before its holdings were transferred to Young India in 2011. AJL published the newspaper until 2008. AJL also owns real estate property in various cities. The value of real estate of AJL is estimated to be at Rs.50 billion. Young Indian is a private company incorporated in November 2010 with a capital of Rs5 lakh and its registered office, Herald House, Delhi. The company's 76 percent shares are held by Sonia Gandhi and Rahul Gandhi equally and the rest are held by Congress leaders Motilal Vora and Oscar Fernandes (12 percent each).
It was alleged that AJL approved the transfer of unsecured loan of Rs.90 crore from the All India Congress Committee at zero interest with company's all 9 crore shares of Rs.10 each to Young Indian. On 7th December 2015, the Delhi High Court dismissed the appeals of Sonia Gandhi, Rahul Gandhi and five others .and ordered them to appear in person before the trial court on 9 December. Delhi High Court said, this Court finds no hesitation to put it on record that the modus operandi adopted by petitioners in taking control of AJL via Special Purpose Vehicle, i.e., Y.I., particularly, when the main persons in Congress Party, AJL and Y.I. are the same, evidences a criminal intent.
On 7 December 2015, Delhi High Court ordered Sonia Gandhi, Rahul Gandhi and 5 others to appear in person before the trial court on 9 December. However, they did not appear in the trial court on said date and their lawyers requested the trial court to defer the hearing. The trial court then ordered the accused to appear in person on 19 December 2015.
Many shareholders of AJL have alleged that no notice was served on them by AJL for any meeting of the shareholders and that the shares held by their fathers have been transferred by AJL to "Young Indian " fraudulently without their consent. These include prominent persons such as the former law minister Shanti Bhushan whose father had purchased shares of AJL in 1937 and Markandey Katju, former judge of Supreme Court, whose grandfather Dr. Kailash Nath Katju was one of the original seven subscribers to the AJL in 1937. Opposition is hell bent upon to disrupt the functioning of the parliament just to avoid any debate on any issue, and are looking for flimsy grounds to halt the proceeds of the parliament without understanding the cost involved in the functioning of the parliament. If they had any concern for the people of India, rather the poor people, they should have cooperated with the Govt. to carry on some legislative business.
Recently in the demolition of illegal structures on the railway tracks in Delhi, which was legal, opposition made it an issue and disrupted the functioning of the Parliament. If there are illegal structures on Govt. land, does it not require its removal? Secondly who are these people who have raised these illegal juggi jhompri? Where from they have come? Why they have come? Instead of cooperating and coordinating with the investigating agencies, they are making an issue and using it as a tool for disrupting the functioning of the parliament and vote bank politics. Aam Adami Party (AAP), which is no longer different from other political parties and its leader Delhi Chief Minister Arvind Kejriwal also joined in opposing the Govt. Arvnid Kejriwal should have appreciated to ensure that such illegal structures do not come up again, they also jump to disrupt the parliament with the support of other opposition parties like JD (U), TMC, in the name of democracy.
CBI has now raided the office of principal secretary to Delhi Chief Minister, Rajinder Kumar, for allegedly abusing his official position by favouring a particular pvt,. firm in the last few years in getting tenders from the Delhi Govt. Depts. Searches were conducted at 14 places in Delhi and UP. CBI recovered documents of three immovable properties along with 2.4 Lakh cash and Foreign Currency worth Rs. 3 Lacs from his residence. It was reported that principal secretary is not cooperating. He was not even opening his email address. Delhi Chef Minister Arvind Kejriwal, who, I should say, cheated the people of Delhi in the name of Anti-Corruption and presenting himself as the epitome of honesty, instead of supporting the move of CBI calls it as raid on the office of Delhi CM, which is factually wrong. Arvind Kejriwal calls it a political vendetta and has used very filthy language while referring to PM. He called PM as "Coward "and 'Psychopath". I wonder how Arvind Kejriwal has appointed him as his Principal Secretary, when there were already allegations of corruption against him.
The opposition should realise that there are other important bills like GST and Land bill pending in the parliament and should also keep in view the cost involved in running the parliament. Most of these congress leaders are rogues who have looted the country and polarised the Indian society on cast and religious lines. Simply in the name of democracy, they have made it a mockery and turning the temple of democracy into a circus of jokers.
