Ration supply embezzlement: DB directs banks to release 2/3rd salary of applicants | | | Early Times Report
Jammu, Dec 19: In a Public Interest Litigation (PIL) regarding misappropriation of food grains meant for public, a Division Bench (DB) of state High Court comprising Chief Justice N Paul Vasanthakumar and Justice Bansi Lal Bhat directed the bank authorities to release 2/3rd of the salary of each of the applicants from their respective salary account numbers from the salary payable from the month of December, 2015 onwards until further orders. After hearing both the sides the Division Bench observed that the applicants have challenged the recovery orders before this Court in separate writ petitions and in PIL 44/2013 and in pursuance of the directions issued by this Court by order dated 06/06/2013, the bank accounts and assets have been attached due to which monthly salaries of the applicants have not been released by the Bank and counsel for the non-applicant/writ petitioner submitted that crores of rupees are required to be recovered from the applicants and others. Court also observed that counsel for the applicants has not produced any document to show how much amount is ordered to be recovered from each of the applicants and how much amount is available in their salary account numbers, enabling us to release the entire salary, as prayed for. Division Bench after gone through the facts observed that the applicants are not getting their salaries, Division bench is of the view that interest of justice will be met by directing the bank authorities to release 2/3rd of the salary of each of the applicants from their respective salary account numbers from the salary payable from the month of December, 2015 onwards until further orders.
