Fill vacancies of IC's in 3 weeks, SC directs GoI

New Delhi, Jan 10: The Supreme court has directed the government of India to fillthree vacancies of Information Commissioners within three weeks.
The Apex Court's double bench comprising Justices J S Khehar and C Nagappan while disposing off a petition said that it has already granted the time sought by the Centre, which should now appoint the ICs within this time period. The bench was hearing the plea of the central government filed against the November 6 Delhi High Court order asking it to appoint three Information Commissioners at Central Information Commission.
It is pertinent to mention that Delhi High Court had asked the Department of Personnel and Training (DoPT) to
fill up the vacancies within 6 weeks from among the 553 applications received by it in response to two notifications issued in 2014 as the vacant posts have led to a massive backlog of cases.
The Delhi High Court's order had come on a Public Interest Litigation (PIL) filed by noted RTI activists Commodore (Rtd) Lokesh K Batra, Subhash Chandra Agarwal and R K Jain. The activists had alleged that
no action has been taken on the issue despite two "distress" letters written by CIC to the Prime Minister's Office (PMO). The PIL filed in the High Court through noted lawyer Prashant Bhushan had sought filling up of posts of Information Commissioners and subordinate staff in a time-bound frame.
It is worth mentioning here that State Information Commissioner of J&K State Information Commission (SIC) Dr S K Sharma retired in October last year and till date the said vacancy is yet to be filled.
The RTI cases (appeals and complaints) related to Jammu division are piling up at SIC office Jammu. As on date the Chief Information Commissioner (CIC) G R Sufi looks after these cases himself. RTI Activists in J&K have been urging upon the Government to appoint new Commissioner to SIC but till date the said process hasn't began .
