Jammu, Jan 14: In the mysterious disappearance of 12-year-old Vishal Sharma, a student of 6th class, from Vijaypur near here, High Court vacation judge Janak Raj Kotwal today directed J&K home secretary and DGP to file their personal affidavits or the affidavit of a responsible police officer as to why the investigation of the instant case be not transferred to CBI. The case is registered at Vijaypur police station under FIR No 6/2015. The court directive came in a petition filed by Vishal's father Rajesh Sharma. The boy went missing on May 5, 2015 after he left home while playing with the pet of their neighbour Satish Kumar.
The petitioner's counsel drew the court attention towards the polygraph test report of prime suspect Bhushan Kumar, saying it had not revealed anything with regard to the missing of the boy. Even as police had filed various status reports, the minor had not been traced so far, he said. It was submitted that after the October 15, 2015 High Court order, a SIT was constituted under the supervision of SSP, Samba, but the boy was yet to be found out. He submitted that the instant case "relates to child trafficking and some inter-state gang is involved in the lifting of the child and for tracing him, the case investigation is required to be entrusted to CBI which has its branches throughout the country and also has a separate cell dealing with child trafficking". He said the missing boy's parents had no grouse with the efforts made by police but with the passage of time, they were feeling dejected and had been getting sleepless nights. After hearing the petitioner's counsel, Justice Kotwal directed the home Secretary and DGP to file their personal affidavits or the affidavit of a responsible police officer as to why the investigation of the instant case should not be transferred to CBI. Looking into the urgency of the matter, he directed the Registry to list the petition on February 2 next and provide a copy of this court order to the additional advocate general. (JNF)
