Despite SC decree making Aadhar voluntary, authorities treat it compulsory | | | Akshay Azad

Jammu, Jan 14 : Despite explicit judgment of Supreme Court of India making Aadhar a voluntary rather than mandatory provision, the government as well as semi-government authorities have been compelling the citizens to produce the Aadhar card for getting various benefits, in contempt of apex court order. Moreover, making a Aadhar card is being proved a Herculean task, as after get themselves repeatedly registered and get their photographs clicked many citizens have reportedly failed to get the card. Pertinently, Supreme Court of India in its judgement October 16, 2015, in which the constitution bench led by Chief Justice of India HL Dattu had observed that Aadhar card was a purely voluntary and mandatory provision and authorities cannot insist on a citizen to produce his Aadhar card. The SC had also extended the voluntary use of card to Mahatma Gandhi National Rural Employment Gurantee Act (MGNREGA), all types of pension schemes, employee provident fund, LPG subsidy, PDS and Prime Minister Jan Dan Yojana. A Plus 2 lecturer Sumita Sharma informed Early Times that the administrative wing officials had asked her to produce the Aadhar card, otherwise the salary would be withheld. "I had objected to the decision, giving the plea of Supreme Court judgment, but the officials simply said, your salary will not be released and it is the order of the government, after which I went for making Aadhar card", she said, adding that even in primary and secondary schools, even the Aadhar cards of pupils were also sought by the administration and it was beyond imagination as for what the information was required. An employee of JK Agriculture department Suresh Katoch informed that in their department also all the employees had been asked to produce their Aadhar card for release of their salaries. "It appears that Aadhar is a compulsory provision and not a voluntary provision and higher officials are also enforcing the compulsory provision", Katoch said, adding that for the pension scheme also Aadhar was made compulsory. Raising finger over the process of making Aadhar card, he further said that in the last one year, he had got his photographs clicked thrice and registered his family in various offices in Jammu city, but still his family didn't get the Aadhar card. "Even, I had approached to head office of Aadhar card near Dudadari Mandir in Gandhi Nagar but the female official present there had asked me to re-registered and when I went to Janipur for registration they gave me a date of next month", he said, adding that on one hand for release of salary, authorities were demanding card and on the other it was not possible to get Aadhar card after registering thrice and in that cycle, he got frustrated. Another citizen Suresh Kumar said that for getting LPG gas subsidy in 2016, the agency owners have asked to produce Aadhar card, otherwise subsidy would not be given. "We have applied for the Aadhar card but after getting the photographs clicked twice, same is not made", he said. He further rued that already they have numerous I-cards and it was also unknown the future fate of Aadhar as if after next elections, if the new party would come to power, they might introduce another identity card and made it compulsory for citizens. "Instead of doing some public welfare works, we are still in oblivion as what type of public welfare is being done by replacing I cards", he said. The state government must issued an circular from General Administration department, directing all the departments to consider Aadhar as voluntary and not compulsory provision. |
