JKPSC rues obsolete recruitment rules in Govt Deptts

Srinagar, June 16: Jammu and Kashmir Public Service Commission (PSC) has picked up serious loopholes in the existing administrative set in the State by declaring recruitment rules of majority of departments as obsolete. The Commission has censured various administrative departments for causing inordinate delay in filling the vacancies by delaying submission of year-wise break-up of vacant posts and has also asserted that the seniority of desirable candidates remains chocked in absence of Annual Performance Reports(APRs).
According to the Annual report 2014-2015,the recruitment rules of most of the departments are obsolete and do not meet the changing requirements. "Many new subjects have been introduced in different universities and large number of candidates have qualified in these subjects. However, such candidates are ineligible to apply for the posts as they do not fulfill the requisite qualification as provided in the existing recruitment rules," the report reads. "In many departments, recruitment rules have been framed way back in 1960's. In departments like Agriculture, the rules are so complex that it becomes difficult to consider officers for promotion."
The report said that one of the causes of litigations could also be attributed to faulty recruitment rules. "It's imperative that the massive review of recruitment rules is undertaken by all the departments and necessary amendments incorporated," it states. "For many services like Forest Protection Force, the recruitment rules have not been framed at all. The direct recruitment could not be done even though the FPF was constituted way back in 1977."
The Commission has held various departments responsible for delay in promotions, selection and regularization process. "At majority of the times, the result, section, and regularization process is delayed for just want of a minor clarification," the report reads.
The Commission, in its report, states that majority of promotion cases remain pending for want of issues of a final seniority list, annual performance reports (APRs) and integrity certificates. "Majority of the departments also fail to submit the year-wise break up of vacancies," the report reads. "The APRs received from various departments are often found incomplete. In case of Housing and Urban Development department, Industries and Commerce, health and Medical Education, and Finance Department, the APRs were submitted without reviewing and accepting as required under rule."
The Commission advocates that "this practice needs to be stopped." It has also accused the key departments of not taking the PSC seriously. "It has been observed that after submitting the proposals, the administrative departments like Finance, Higher education, Forest and Rural development never bothered to respond the communications regarding the deficiencies or any query regarding the proposal even after protracted correspondence from the PSC," the report reads.
The report further states that some departments don't represent in the Departmental Promotional Committee meetings on the date fixed by the Commission. "In scores of cases, the Commission has noticed that without any justification, the departments ignore otherwise eligible offices and juniors are placed on higher posts. The condition of placement for regularization needs to be revived to ensure fairway and justice to all," the report advocates.
The report also holds various departments for making Own Pay and Grade (OPG) arrangement on pick and choose basis. "As per the set procedures, OPG arrangement shall not last beyond six months. However, officers placed in OPG continue beyond six months which is violation of set rules and is against the spirit of judgment of the Apex Court passed in the case titled Suraj Prakash and others Vs. State of J&K and others," the report reads.
The Commission, according to the report, has not received any case of disciplinary proceedings in last three years. "This is in violation of section 133( c )of the constitution of the State," the report states.
