Hostile prosecutrix leads to acquittal in rape case | | | Early Times Report
jammu, June 16: Presiding Officer Fast Track Court Kishore Kumar acquitted Kuldeep Kumar and Sajan Kumar from the charges of kidnapping and rape as the prosecutrix has resiled (backed) from her earlier statement made under section 164-A Cr.P.C. While acquitting accused from the charges, Presiding Officer Fast Track Court Kishore Kumar observed no person, accused of rape, can be convicted if the witnesses specially the victim or her parents do not support the prosecution case or give the quality evidence as in the present case where the prosecutrix itself has resiled from her earlier statement made under section 164-A CrPC. "Since the ace witness and her father have resiled from their earlier statements made before the Magistrate thus the conviction of the accused is not possible in the circumstances of the case," court added According to case father of the prosecutrix has filed a written application to the police stating therein that her daughter (name with held), had gone to the fields to attend the nature's call on 07/06/2015, where both the accused were already hiding, they threatened the prosecutrix and forced her to sit on a motorcycle and took her to room at Pir Gujran where both the accused persons threatened her for solemnizing marriage with accused no. 1 who used to forcibly commit rape upon her after threatening her. On this a case under FIR NO 206/2015 u/s 376, 366, 343, 109 RPC was registered and investigations were undertaken. (JNF) |
