Court directs Law Secretary to clear position | | | Srinagar, July 4: Jammu Kashmir High Court Monday directed Law Secretary to appear physically along with records before the court to clarify why the government erred in making the recommendation for appointing former High Court Judge, Justice (retd.) Imtiyaz Hussain as head of the State Human Rights Commission given the fact that Chief Minister Mehbooba Mufti-led selection panel's recommendation "was in contravention of the law that makes the chairperson and members of State Accountability Commission, on ceasing the office, ineligible for any assignment or appointment to be made by the Governor." The Division Bench of Jammu and Kashmir High Court comprising Chief Justice Vasant Kumar Paul and Justice Ali Muhammad Magray expressed displeasure over government's inability to recommend a right and deserved person for the post of chairman SHRC. The Division Bench while coming down heavily on Jammu and Kashmir Law Department sought the presence of Law Secretary along with records on 12 July to clarify his position. The court made these observations on a Public Interest Litigation filed by General Secretary Jammu Kashmir People's Forum MM Shujah. The Forum was represented by Advocate Nadeem Qadri and Advocate Shafqat Nazir while the state was represented by Additional Advocate General Muhammad Iqbal Dar. |
