Separatists' supporter Noorani unhappy with CM | | | Early Times Report JAMMU, July 4: Mumbai-based A G Noorani, who has been right in favour of Pakistan, China and Kashmiri separatists since decades now, is unhappy with J&K CM and PDP president Mehbooba Mufti. He says the PDP committed a blunder by stitching an alliance with BJP after surrendering Kashmiri interests. His another grouse her and her party - apart from the Congress - is that the PDP stitched an alliance with the BJP without getting an assurance that all the laws introduced in the state after 1953 shall be withdrawn from the state and the state would get a treatment different from that of other states of the Union. To make his point, Noorani, the other day said: "She (Mehbooba Mufti) knows very well that Article 370 has been reduced to an empty shell by the 47 Orders unconstitutionally made by the President of India for 50 years on the advice of the Government of India; from 1954 to 1994. All of them were run by the Congress Party, of which her father Mufti Mohammed Sayeed was a member. 260 out of the 395 Articles of India's Constitution were extended to Jammu & Kashmir. So were 94 out of the 97 entries in the Union List - leaving a balance of 3 for the State to "enjoy". 26 of the 47 entries in the Concurrent List were also extended to the State. 7 of the 12 Schedules were applied". He has further said: "This is not 'erosion' of Art. 370. 'Erosion' is a natural process by efflux of time. This was a calculated, systematic hollowing out of Art. 370. Far from giving Kashmir a preferred status over the other States, it has been put in a position inferior to them. One illustration alone will suffice to prove this. Both Houses of Parliament had to amend the Constitution of India, by an elaborate process under Art. 368, as many as four times to extend President's Rule in Punjab imposed on 11 May1987. They were the 59th, 64th, 67th and 68th Constitution Amendments. For the State of Jammu & Kashmir, mere executive Orders under Art. 370 sufficed; from 18 July 1990 to 1996. They were dated 24 February 1993 and 19 February 1994. Each was made 'with the concurrence' of the Government of the State of Jammu & Kashmir". Noorani is absolutely wrong. The PDP didn't surrender anything; it was the BJP that surrendered. The PDP-BJP Agenda of Alliance recognizes "the different positions" of both parties (PDP and BJP), appreciates the perceptions of the BJP and the PDP have on the constitutional status of J&K and maintains the state's special status. It says, "considering the political and legislative realities, the present position will be maintained on all the Constitutional provisions pertaining to J&K". All this shows that it was the BJP, and not the PDP, which did a complete U-turn on Article 370, and stitched alliance with the PDP knowing it well that the arrangement with the PDP will not go down well with its own constituency in Jammu and elsewhere in the country. Not only this, the BJP also allowed the PDP to walk away with all the vital portfolios and have more Cabinet Ministers. But Noorani will not appreciate all this. For, his objective is sinister. He has been for a regime that drives J&K completely out of India. He wants a regime that empowers Kashmiri separatists to "Use Article 370 itself to restore the original special status of the State". This is not going to happen. Times have changed. |
