Jammu, July 17: In a case, where the services of a doctor were terminated after a young woman, who had later delievered a dead foetus, was made to wait at Atholi hospital, Kishtwar, high court judge Janak Raj Kotwal today ordered that, subject to objections from other side, the petitioner's termination would remain stayed. One Sushma Devi (24) was brought to Atholi hospital with half of the baby's body out of birth canal and head stuck up. She was allegedly made to wait for two crucial hours as three doctors. In his petition, Dr Rakesh Kotwal submitted through his counsel that he was on leave from May 30, 2016 to June 2, 2016, and on his application, the leave was further extended for three days. It was submitted that his termination was caused by an incident that occurred at Atholi PHC on June 4, 2016 when Sushma Devi was said to have delivered a dead foetus in the absence of doctors on duty namely Dr Asfiya and Dr Rakesh Kotwal. "The grievance of the petitioner is that his services have been terminated without providing him an opportunity of being heard and ignoring that he was on sanctioned leave on the date of incident," Justice Kotwal observed and issued notice to state and others. He ordered that subject to objections from the other side, order of termination would remain stayed. The court had on July 4 stayed the termination of Dr Asfiya. (JNF) |
