Despite Court stay, GMC&H finalizes selection list of 16 FMHW

Jammu, July 17: Lack of coordination among the government departments can be gauged from the fact that a letter forwarded from the office of Secretary Service Selection Board (SSB) to Government Medical College and Hospital (GMC&H) took around one month time.
The delay in the communication led GMC&H administration to publish the final selection list of the 16 Female Multipurpose Health Workers in Health and Medical Education Department Divisional Cadre Jammu.
Sources said that the Principal of Government Medical College and Hospital (GMC&H) Jammu and Administrator Associated Hospitals Jammu have allegedly violated directions of High Court and finalized the appointment of 16 Female Multipurpose Health Worker in Health and Medical Education Department Divisional Cadre Jammu.
As per order no 166/AHJ/2016 dated 12-07-2016, the Principal of Government Medical College and Hospital Jammu has accorded sanction to the appointment of 16 Female Multipurpose Health Worker in Health and Medical Education Department Divisional Cadre Jammu and the same was advertised in the newspapers.
As per details available with Early Times, the counsels for the petitioners stated that petitioners in the instant petition are identically situated as the petitioners in Special Writ Petition (SWP) no. 489/2011 and therefore, are entitled to the same relief namely for being allowed to continue on the posts held by them till completion of 7 years whereafter they would be entitled to regularization.
Counsel further stated that despite the position as emerging from the order of the court in SWP no. 489/2011 respondents have issued advertisement notification no. 5 of 2015 dated 01-09-2015 inviting applications for appointment to the posts held by the petitioners.
Counsel maintained that in case the interim relief as granted in SWP no 489/2011 is not granted in favour of the petitioners herein, their claim would be severely prejudiced.
The order further reads that till next date before the bench and subject to filing of objections by the other side, status quo as on date shall be maintained. It is made clear that in case the official respondents continue with the selection process, the same would not be finalized without the permission of the court and would be subjected to outcome of the writ petition.
However, the Service Selection Board (SSB) has intimated the Principal of the Government Medical College and Hospital and the Administrator Associated Hospital Jammu that the High Court on 09-09-2015 in an interim order has directed till next date before the bench and subject to filling of objections by the other side, status quo as on date shall be maintained. It is made clear that in case the official respondents continue with the selection process, the same would not be finalized without the permission of the court and would be subjected to outcome of the writ petition.
The letter of the Secretary, Service Selection Board to the Principal and administrator reads that "The select list for the said post has been forwarded to your department however you are requested to file objection in the instant matter and seek vacation of interim order before issuance of formal order of appointment".
Administrator Associated Hospital, Babila Rakwal when contacted said that the process was finalized after the approval of Service Selection Board but the letter of the board directing not to finalize the list was reached in the GMC&H after the list was finalized and after receiving the letter the list was kept abeyance.
