HC orders to shift adv Wazir to AIIMS | IGP directed to find out how he had gone missing | | Early Times Report
Jammu, Aug 8: High court judge Tashi Rabstan today directed GMC principal to shift advocate Raman Wazir to AIIMS. He also directed IGP, Jammu, to enquire how he had disappeared, under which circumstances he reached Chandigarh and what happened during the period he remained untraced. Besides checking CCTVs installed en route Chandigarh from the spot from where Wazir got missing, IGP was directed to also check the footage of CCTVs installed in and around shop No 26, Sector 11, Chandigarh, to know whether it was Wazir or somebody else who had accessed his e-mail, the reference of which was given in the status report as well as in the media. During investigation, if police 'feel to interrogate any person, they would be at liberty to do so whosoever influential he may be, and take action strictly in accordance with law'. Justice Rabstan also directed the DGP to provide fool-proof security to the patient en route till he was admitted in AIIMS, New Delhi. The DGP was also directed to provide security to the family members of Wazir in Jammu. However, security to family members would depend upon the outcome of investigation, he said. Earlier, GMC principal told the court that although the medical tests conducted upon Wazir appeared to be normal, neurologically he was in a semi-conscious state and that he was not as yet fit for making a statement. He stated that he had a brief interaction with Wazir with gestures and it seemed as if he he had pain in legs, abdomen and head and that he did not know how he reached Chandigarh. He stated that no apparent injury was found on his body. The principal said since Poison Detection Facility was not available in Jammu, Wazir required to be referred to AIIMS in New Delhi today itself. Justice Rabstan observed that since it had been advised to refer the patient to AIIMS in New Delhi, its Medical Superintendent was impleaded as party respondent to the petition. He ordered the registry to accordingly update the cause title, observing that since the Wazir had been recovered by police, the purpose of present habeas corpus had been achieved and the SIT was accordingly dissolved. However, keeping in view the concern of Wazir's family members and bar members that there was some foul play in his mysterious disappearance, the instant petition was disposed of with the direction that IGP, Jammu, would enquire how he had disappeared, under which circumstances he reached Chandigarh and what happened during the period he remained untraced. Justice Rabstan also directed the SIT incharge to hand over the complete record of investigation to the concerned police agency forthwith, which will start investigate the whole episode from today itself. The court also the GMC principal to properly conduct Wazir's medical examination till he was admitted in Jammu. Any lapse on the part of investigating agency or Medical Board would be viewed very seriously, he ordered. The court said it would be up to the medical board to advise how he had to be shifted to New Delhi, either in an Intensive Care Ambulance or Air Ambulance. However, in both the situations, a senior doctor along with required medical staff would accompany the patient till he was admitted in AIIMS and the DGP was directed to provide fool-proof security to the patient en route till he was admitted in AIIMS, New Delhi. The DGP was also directed to provide security to the family members of Wazir in Jammu. However, security to family members shall depend upon the outcome of investigation, the court said. The court said the state government, in consultation with Union of India, was directed to provide full security to Wazir in AIIMS, New Delhi. Keeping in view the statement of GMC principal, AIIMS Medical Superintendent was directed to conduct thorough medical examination of the patient and to verify whether he had been administered any type of intoxicant/drug, the court ordered.
