Faced with 'sedition' charges, Imam gets anticipatory bail | | | Asif Iqbal Naik Early Times Report
Kishtwar, Oct 9: Bun Astan mosque's Imam, who was faced with alleged sedition charges, has been granted anticipatory bail by the court of principal district and sessions judge, Kishtwar, after police failed to submit their reply to bail application of the accused. He was accused of playing a lead role in the anti-national protests that took place in the town here after the killing of Hizb terrorist Burhan Wani on July 8, 2016 by forces in an encounter in Kashmir. Principal district and sessions judge M S Parihar, in response to the application moved by accused Manzoor Ahmed Ganie, son of Mushtaq Ahmed Ganie of Bun Astan, Kishtwar, in terms of section 497-A of CrPC, granted him anticipatory bail. In the bail application submitted through his counsel, he said he was innocent and had not committed any offence, adding that in case of his arrest, his reputation would be spoiled. After going through the bail application submitted by him on October 3 last, the court accordingly sought details from the SHO of Police Station, Kishtwar, which he could not submit. "I have gone through the application and considered the submission made by the counsel for the applicant. The submission appears to be genuine. The perusal of the application shows that the applicant is apprehending his arrest, the detail of accusation against him is not known and till the detailed report is submitted by the SHO, the applicant deserves protection," reads order No 713/SJK of October 8, 2016 of the judge. The judge directed the SHO that in the event of arrest of applicant, he be released on interim bail on his furnishing personal bond of Rs 10,000 and surety of the like amount provided he was not involved in any offence which carried punishment of more than seven years or any offence under any Special Act or any offence in which special bail provisions had been made or any offence under sections 306, 376, 366 and 363 of RPC. "The applicant is directed that he will not directly or indirectly make any inducement, threat or promises to any person acquainted with the facts of the case, so as to dissuade them from disclosing such facts to the court or to any police officer, he will not interfere with prosecution evidence directly or indirectly and will appear before the Investigating Officer during the interim bail period as and when directed by him to do so," reads the order. The court also barred him from leaving the jurisdiction of the court without its prior permission or Investigating Officer and put up the case for next hearing on October 20, 2016. As already reported, over three dozen persons, including some government employees, are facing sedition charges under sections 120-B, 124-A and 153-A. Manzoor Ahmed Ganie was named in FIR No 157, 158 and 174 and was absconding since Kishtwar police raided his residence during intervening night of 24/25 September while two other accused namely Abdul Qayoom Mattoo (Imam of Masjid Umar Mohallah) and Saif-ud-Din Bagwan were booked under PSA while three others including Firdous Ahmed Bagwan, Ajaiz Ahmed Kelam and Syed Asif were presently in Judicial Custody in District Jail, Kishtwar. Following arrest of these five persons, the district administration had imposed curfew in Kishtwar for three days. Many among those named in the FIRs have either gone into hiding or have left Kishtwar. |
