Probe in VO FIR against Tehsildar stayed | | | Early Times Report Jammu, Nov 3: High court judge Janak Raj Kotwal today issued notice to SSP vigilance and ordered that subject to objections from other side, investigation in the FIR, registered against a tehsildar and others in a corruption case, shall remain stayed. The court directive came in a petition filed by then tehsildar Pawan Kumar Kohli and others, seeking quashment of March 8, 2016 FIR No 7 registered by the vigilance organisation (VO) against the petitioners for commission of offence punishable under section 5(1)(d) read with section 5(2) of the J&K Prevention of Corruption Act and sections 468, 471 and 120-B of RPC . A verification conducted into the allegations against the revenue officials of Bishnah and some private parties had revealed that Gagu, son of Fulla and his other family members were in possession of a land measuring 16 kanals and 15 marlas under khasra No 217 at Mehmoodpur, Bishnah, as per khasra girdwari register from 1969 to 2001. The land belonged to custodian department and these people were also shown as local allottees in the revenue record. On January 13, 2001, the revenue officials cancelled the Sahat Kasht Girdwari of Gagu and others and entered the name of Sheela Wanti, wife of Khayali Ram in their place illegally, VO sources said. During the course of verification, it was found that the land was situated at a very prime place and had handsome market value and the land mafia was aggressively pursuing the case of possession of the said land. One Satish Kumar, son of Lachman Dass of Bishnah was also found having obtained the Power of Attorney of the land and finally purchased it from Sheela Wanti illegally against a sum of Rs 80,000, knowing that the land was of Evacuee Property and could not be purchased. The petitioners' counsel submitted that the impugned FIR was bad in the eyes of law on the ground that they had not committed any offence. Whatever action was initiated and taken by the petitioners while serving as tehsildar and patwari at that point of time was strictly in consonance with the provisions of law and based on the documents which were produced before them. |
