HC seeks explanation from SSB chairperson | Non-compliance of court orders to make food testing labs 'functional' | | Early Times Report Srinagar, Nov 3: The state high court has ordered the SSB (service selection board) chairperson to explain non-compliance of its orders regarding recruitment of technical staff for the food testing laboratories in Jammu and Srinagar. In a suo moto PIL, the court had on last date of hearing directed him to appear in person before it if the selection of technical manpower for the laboratories was not completed by next date of hearing. The chairperson, despite the court order, was not present in the court and had instead filed an application, seeking exemption from personal appearance. "Perusal of the application shows that no ground, not to talk of substantial ground, has been urged in the application," a division bench of Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey observed. In the application, she had stated that she was presently out of station because of personal urgency and was not in a position to attend the court in person. "Nothing is stated as to what was personal urgency. This application, however, is filed by the secretary SSB and not by the chairperson of the board," the court said and took strong exception to the procedure adopted by the chairperson. "The chairperson is to explain her conduct in not complying with the court order and not filing of application herself. The secretary must remain careful in future in dealing with the court matter," the court said. The court also directed the government to file report about the setting up of appellate authority both in Srinagar as well as in Jammu. "The government shall expedite and constitute these authorities before the next date and file compliance report," the court said and directed listing of the case in the week commencing from November 21. General Manager, J&K Medical Supplies Corporation Limited, was present in person. He filed compliance report on behalf of the Managing Director, Jammu and Kashmir Medical Supplies Corporation Ltd. "On next date MD, J&K MSCL to remain present before the court," the bench said. On September 9, the court had directed government to file status report by September 29 regarding steps taken to make the two food testing laboratories functional. On June 10, the court had observed that a lot was required to be done by the government to alleviate the sufferings of the people due to food adulteration. It had ordered the government to make the two food testing laboratories functional by July 11. Besides, the court had also directed government to fast-track appointment of technical manpower as per the Food Safety and Standard Act of 2006. Chief Secretary B R Sharma, who had appeared before the court, had admitted that the FSSA 2006 had not been implemented in the manner it had to be implemented in the state. He, however, had assured the court that he would immediately take review of all aspects concerning the implementation of FSSA. He had also assured that without waiting for the financial assistance from the Government of India, funds for setting up "technologically advanced laboratories" both in Jammu as well in Srinagar would be immediately provided by the state and the laboratories would be established shortly. |
