College prof denied bail in sedition case

Jammu, Dec 10 : Principal sessions Judge, Kathua, Vinod Chatterji Koul has rejected the bail application of a government college professor who was booked by Bani police in a sedition case.
Accused Shah Nawaz, son of Mohammad Latif Dar of Dogripora near Awantipura in Pulwama, Kashmir, was booked by police in a sedition case on the basis of investigation into a written complaint lodged against him by his students.
According to the police case, the written report was made with Bani police station on November 30, 2016 and a copy of the report was sent to the district magistrate, Kathua, for filing a formal complaint. Nawaz was arrested and after obtaining the complaint from the district magistrate, a case for offence punishable under section 153-A of RPC was registered.
In their report, Manoj Kumar, Tilak Raj, Ganesh Kumar and Subash, all students of B A Part-III, alleged that while teaching them history, Prof Nawaz started giving lecture on the Samba and Nagrota encounters on November 29, 2016.
"He said Pakistanis come here as lions, kill Indians and then go back. He also claimed that there are 150 militants in Kashmir for whom he can give his life. He also said that they are having fire arms like AK-47 rifles and he will provide them all types of assistance. Some students are following the professor as a result of which the peaceful atmosphere of the college is getting disturbed. These students come to the college in Afgan clothes," the students alleged in their report.
As per the investigation conducted into the case, police had found the offence punishable under section 153-A of RPC established against the accused.
The judge, after hearing both the sides, observed that in view of the provision contained in section 497-B of CrPC and the fact that there were grounds for believing that he had committed the offence. Observing that the alleged incident had taken place only two weeks back, the court rejected his bail application.(JNF)
