CJM directs CB to register FIR against affluent accused | Attempt to usurp KPs Land | | Saahil Suhail

Anantnag, Apr 9: Chief Judicial Magistrate Anantnag has directed Crime Branch Srinagar to register an FIR against four persons who produced fake documents in a bid to grab land belonging to KP migrants. Sources told Early Times that the accused persons have grabbed the land of Kashmiri Pandits in Anantnag through forged documents. "Accused persons belonging to influential family of Anantnag town have grabbed the land with the help of militants way back in 90's," they added. Jahangir Ahmad Khan, who has filed the complaint on behalf of a Kashmiri Pandit family, told Early Times that influential people mutated the land belonging to Kashmiri Pandits in their names. He said that fraudulent transfers have been done and legalized by the officials of the State Revenue Department in return for bribes. "The method usually adopted by the land grabbers in connivance with Revenue officials, especially the Patwaris, is to get some local villagers as witnesses to testify that the land holdings in question had been sold or transferred by the owners." He added. He said that tampering has been done with the Revenue records by Revenue officials from time to time. Sources said that scam surfaced after the accused produced fake documents in the court fallowing which Chief Judicial Magistrate directed Crime Branch to investigate the matter. The order issued by the CJM Anantnag on 14th of March this year reads, "This complaint is submitted before this court by Counsel Prince Tanveer Ahmad. I have gone through the contents of the complaint. The matter is with respect to forged/cheating and forgery making a false document. Therefore, commission of cognizable offence is noticed which requires to be investigated thorough Crime Branch Srinagar." The CJM has directed SHO Crime Branch Srinagar to investigate the matter under section 156 (III) Cr.P.C and submit the report by or before 20th April. Pertinently Jammu and Kashmir has a 'Migrant Immovable Property Act, 1997' through which District Magistrate can take over the possession of immovable property, belonging to Migrants, falling within his territorial jurisdiction and also has to take all such steps for preservation and protection of such property. |
