Grants bail to alleged rape accused

JAMMU, Sept 9: Granting bail to an alleged rape accused, high court judge Tashi Rabstan today observed the role and conduct of SHO of Domana police station seemed to be doubtful and directed him to remain present in the court on the next date of hearing.
"The manner in which the SHO has handled the present case creates many doubts about the fair investigation being conducted by him in this case. Therefore, he is directed to remain present before the court on the next date of hearing at 8 am sharp along with the complete latest status report and also the action taken report on the complaint of petitioner," he observed and directed to send a copy of order to SSP, Jammu, for compliance.
While granting bail, Justice Rabstan observed that in the present case, it be seen that the complainant herself had made a statement before the SHO of police station (women cell), Jammu, on February 14, 2015 that whatever allegations she had levelled against the petitioner herein were baseless. Her statement had also been countersigned by her father. While withdrawing the complaint, the complainant in her written statement had not alleged that she was ever raped by the petitioner, rather she had specifically stated that whatever allegations she had levelled against the petitioner were baseless. She had also stated that she was making the statement in full sense and without any coercion or pressure. It is to be seen here that the complainant withdrew her complaint against the petitioner. Further, it is to be seen that only after petitioner herein lodged a complaint against respondent No 2 on February 4, 2015 before CJM, Jammu, for extortion and criminal intimidation, that the SHO of Domana Police Station registered an FIR against the petitioner for commission of alleged offence of rape against him on February 15 and took him on remand for eight days, but he did not take any action on the complaint of petitioner which he has filed against complainant. It seems that the SHO Police Station Domana is investigating the matter in a biased manner, the court observed.(JNF)
