Govt failed to protect constitutional rights of backward classes: AIC | | | Early Times Report Jammu, Oct 10: In the aftermath of Jammu and Kashmir High Court judgment that there shall be no benefit of reservation in promotions in the state, All India Confederation of SC/ST/OBC organisations, J&K today blamed the present PDP-BJP government in failing to protect the constitutional rights of backward classes. "The present government has failed to protect the constitutional rights of reservation in promotion of the SC/ST/OBC, RBA and LoC category employees/officers in the court of law, R K Kalsotra, president of the organisations told reporters here. He said the judgment is likely to do irreparable financial and status loss to the category officials in particular and the weaker sections in general as there is merely 2 to 3 per cent reservation for reserved category in government services. Reservation in J&K started in 1970 for SC, ST in 1991 and OBC where as it was commenced in 1950 in rest of the country, he asserted. Kalsotra said, " It is entirely the failure of the government which could not defend its own Reservation Act 2004. Ever since the constitutional amendment of Article 77, 81, 82 and 85 have been made by Parliament, we have been asking the state government from time to time to get the said amendments passed in state assembly. Though the Reservation Act 2004 has been passed by the state Assembly after the said amendments but the ruling class has always been ignoring the interest of the reserved categories." Kalsotra added that the government is forcefully impressed upon to do everything for protection of the constitutional rights of the reserved categories. In the meantime he also asked the 'Law Department' not to implement the judgment. The Confederation president, however, requested the reserved category Ministers, MLAs and MLCs to take up the issue with Deputy Chief Minister and the Chief Minister in whose last tenure the Act was passed. "We will be mobilizing the affected sections of society and called on for a one day biggest ever convention in Jammu on November 1 to educate the people about their bleak future, he added and threatened to gherao the Civil Secretariat on its opening in Jammu on November 9, if the government fails to protect their rights. |
