HC directs DGP to constitute SIT, IGP Jammu to supervise investigation | Mysterious disappearance of minor | | EARLY TIMES REPORT
JAMMU, Oct 15: In a significant order Justice Ali Mohammad Magrey of Jammu Kashmir High Court Jammu Wing today directed Director General of Police J&K to constitute a Special Investigation Team (SIT) comprising of Superintendent of Police, Sub-District Police Officer and the concerned Station House Officer, under supervision of Inspector General of Police, Jammu. Justice Magrey directed that the exercise with regard to constitution of SIT be undertaken by Monday i.e October, 19. These directions were passed in a writ petition filed by Rajesh Sharma resident of Vijaypur whose minor son (12) namely Vishal Sharma went missing on May, 5, 2014 when he went out of his home while playing with a pet belonging to one of the neighbour Satish Kumar. After hearing both sides, Justice Ali Mohammad Magrey further directed that the Special Investigation Team shall immediately put all the mechanism in operation and make an endeavour to trace out the missing boy. The SIT shall file status report by October, 29, 2005 and on the said date the Superintendent of Police heading the SIT shall appear in person alongwith CD file. After hearing both the sides at length, Justice Ali Mohammad Magrey expressed his displeasure over the non-serious approach of the Vijaypur Police in tracing the minor and observed that perusal of the record reveals that there is no material placed by the State with reference to make an endeavour to put their all mechanism in operation for tracing the missing boy or locating his whereabouts. Justice Ali Mohammad Magrey further observed that failure on the part of the State to fulfill its constitutional and legal obligation with reference to tracing out the missing boy shall form a ground for assigning the case to Premier Investigating Agency.
