HC warns to initiate contempt against two top Govt officers | Non payment of salaries to judicial staff: | | Early Times Report
Srinagar, Oct 21: The Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Hasnain Massodi today while hearing a Public Interest Litigation (PIL) warned contempt proceedings against law and finance secretaries over non-payment of salaries to 38 judicial officers and the staff attached to Additional Special Mobile Magistrate. Hearing a suo-motto Public Interest Litigation (PIL), a Division Bench observed that a prima facie case is made out to initiate contempt proceedings against commissioner secretary to government finance department and secretary to government law, justices and parliamentary affairs. However, the court delayed the proceeding against them only after the assurance by advocate General Jahangir Iqbal Ganie that he will use his "good office" in resolving the issue till October 27. Subsequently, the court posted the case 27 October 2015. In August, the Court stayed a cabinet decision regarding the abolition of the 38 Additional Special Mobile Magistrate Courts and directed the government to release the salary of the presiding officers and the staff from next month (September) onwards as well. The PIL was initiated following a report by its registry that 38 Additional/Special Mobile Magistrates and staff attached to the Courts were not paid their salary from March 2015. Registry had stated that the salary required for the judicial officers as well as the staff for the financial year 2015-2016 is Rs 10, 38, 97,152/-. The registry also said that Rs 86,58,096/- are required as monthly salary and an amount of Rs 4,32,90,480/- is needed to be paid as pending salary to the judicial officers and the Court staff for five months from March to July 2015.
