HC directive to fill JSAs' vacancies under promotion quota

jammu, Oct 21:High court judge Janak Raj Kotwal today directed respondents to finalise the process of filling of the available vacancies of Junior Statistical Assistants (JSAs) under promotion quota without any further delay, preferably within eight weeks after petitioners provide the copy of order along with complete paper book to Director General, Economics & Statistics, J&K. Petitioners-Punam Sharma and others, were appointed as Kep Punching Operators in 2011 in Directorate of Statistics pursuant to the selection conducted by the J&K Services Selection Board and thereafter became eligible for promotion to the posts of JSAs in 2014 on basis of their eligibility and qualification as laid down in the J&K Economics & Statistical (Subordinate) Service Recruitment Rules, 1989 and in the wake of availability of number of posts of JSAs. The process for promotion of the petitioners was unduly delayed due to administrative lethargy of Director General, Economics & Statistics, J&K, having failed to convene DPC. Delay in holding and processing the cases of petitioners for promotion to the post of JSAs, to which they were not responsible, cannot be permitted to recoil against the rights vested in them to seek their promotion to the post of JSAs, from the dates vacancies were available in the quota of promotion. It was contended that since the petitioners were entitled to be appointed on promotion to the post of JSAs from an anterior date i.e. from the dates vacancies were available in the quota of promotion, therefore, their seniority needs to be fixed accordingly in the JSA cadre while reflecting them senior to the directly recruited JSAs in terms of Rule 23 of the J& K Civil Services (Classification, Control & Appeal) Rules, 1956. "It is contended further that the department had obtained vigilance clearance about the petitioners and others on March 6, 2015 from GAD (Vigilance Section) and there is no reason for withholding their promotion," held the court.
