Arguments on SAC cases start | HC directs Registry to list case on Thursday | | Early Times Report Jammu, Nov 27: Arguments on the cases of State Accountability Commission (SAC) started today in which its counsel stated that SAC enjoys suo moto power under the Act and issues process for the purpose of holding investigation. He said that the commission was constituted to curb the menace of corruption in the society and the act must be read as a whole. Ex-minister Suman Bhagat counsel submitted that SAC had no powers to initiate suo-moto proceedings and since it lacks powers to initiate suo moto proceedings and the since Court has held regulation 9 framed by the commission assuming powers to initiate Suo-Moto proceeding as the ultravires to the Act and since there was no formal complaints against the appellant as such the petition filed by the appellant could not have been dismissed and ought to have been allowed like the petitions filed by the others were allowed against whom also SAC has initiated suo moto proceedings. The bench, after hearing in length, put the case to be listed on November 26, 2015 for further arguments. It is worthwhile to mention herein that writ petitions were filed by former Deputy Chief Minister Mangat Ram Sharma, Former Minister Abdul Majid Wani, Former Chairperson Khem Lata Wakhloo, Atal Dulloo I.A.S Officer, Jamrod Singh then S.H.O Police Station Sunderbani, Dr. Mohd Din (I.A.S) the then Commissioner/Secretary Animal Husbandry, Dharamveer Koul the then Executive Engineer PWB (R&B) Udhampur challenging the various orders passed by SAC wherein it had made recommendations and in some cases had initiated regular inquiries. |
