Court awards life imprisonment to 2 in murder case

Jammu, Dec 29: 1st additional sessions judge, Jammu, M A Choudhary today awarded rigorous life imprisonment to two murder accused - Harshvardhan, son of Shashi Parkash, and Jagdish Singh, son of Mulkh Raj.
While Harshvardhan hails from Pali in Lansi tehsil of district Puri Gharwal, Uttara Khand, Jagdish is resident of Kothar, Pancheri. They have been sentenced for murdering one Rajinder Kumar.
The judge, after hearing the two sides, observed that the chain of circumstances to prove a case based on circumstantial evidence "is complete in the case and this court reaches the only inescapable conclusion that the victim was killed by none other than the accused. The prosecution has, thus, succeeded to prove its case against the accused for the commission of offence punishable under section 302 of RPC read with section 34 of RPC".
The court observed that the offence under section 302 of RPC "is punishable with death or imprisonment for life and with fine. This is a case of murder. The attending circumstances of the case do not warrant extreme penalty of death sentence. Though a young man lost his life in the instant case by the act of the convicts, it does not fall in the category of rarest of rare cases where the death sentence is warranted. The convicts are, therefore, sentenced to undergo rigorous imprisonment for life, with a fine of Rs 10,000 to each of them for the commission of offence under section 302 of RPC. --(JNF)
