Senor BJP leader's water usage charges

Jammu, Dec 29: The Chief Information Commissioner (CIC) has directed the Estates department to reveal information about water usage charges of a senior BJP leader of State. The said information was earlier denied by PIO of PHE department and First Appellate Authority (FAA) (SE PHE). The matter landed in State Information Commission (SIC) which finally gave directions to reveal this information.
Details available with Early Times reveal that one Gagan Partap Singh filed 2nd appeal through counsel Vilakshana Singh (Advocate) under section 16 of the Jammu & Kashmir Right to Information Act, 2009 before the State Information Commission (SIC) on 01.10.2015 stating therein that he had filed an RTI application before the PIO/Executive Engineer, Public Health Engineering, PHE City Division No. I, Jammu, received on in the said office on 01.06.2015. Gagan Pratap Singh sought following details about the official residence of senior BJP leader Jugal Kishore: Year wise details of water usage charges fixed in respect of Estate Quarter No. 32 A at Ahata Amar Singh Jammu allotted in favour of Jugal Kishore from the year 2005 to 2010; Year wise charges actually paid by Jugal Kishore in respect of 32 A Ahata Amar Singh, Jammu for water usage during the said period indicating the date of actual payment during the each of the aforesaid years along with photocopies of the receipts; Year wise details of water usage charges fixed in respect of Estate Quarter No. 14 at Rehari, Jammu allotted in favour of Jugal Kishore from the year 2010 till date; The pendency of water usage charges in respect of the aforesaid quarters as on May 31, 2014 indicating the water usage charges actually paid along with photocopies of receipts of such payments; The pendency of water usage charges in respect of the aforesaid quarters as on date giving the month wise and year wise details of such pendency.
CIC in its order ruled that as the information is give-able and is on record, possessed and obtained by the Estates Department, therefore, Commission directs PIO, Estates Department who is Executive Engineer, Estates Department, Jammu to provide this information directly to the information seeker with an intimation to the Commission and to the PIO/Executive Engineer, PHE City Division No. I, Jammu in response to his communication mentioned above. The compliance of this order will be made within 15 days from the date of receipt of this order, otherwise the PIO-cum-Executive Engineer, Estates Department will be declared deemed PIO and action under section 17 i.e. penalty provisions of J&K RTI Act, 2009 may be initiated.
