7 years RI to five in murder case | | | Early Times Report Jammu, Dec 30: 1st Additional Sessions Judge Jammu MA Choudhary awarded seven years rigorous imprisonment and fine Rs 50,000/- to Sanjay Kumar @ Sanju S/O Balwant Raj, Balwant Raj @ Shama S/O Mohan Lal, Birbal @ Beeru S/O Bhagat Ram, Anil Kumar @ Bachi S/O Birbal and Vikram Kumar @ Vicky S/O Balwant Raj all residents of New Plots, Jammu in 304-II (culpable homicide not amounting to murder). According to police case one Suresh Kumar S/O Shri Suraj Parkash resident of New Plot Jammu had performed 'Mundan' Ceremony of his son and for covering said ceremony he had engaged Ashwani Kumar as photographer for preparing video cassette of the ceremony and paid his charges to him but, he had not handed over the video cassette of the ceremony to him. On 3rd July 2008 at about 6.00 PM when Suresh Kumar had gone to street no.6 New Plot, Jammu for bringing some vegetables, Ashwani Kumar met him there and Suresh Kumar asked him to give him the video cassette. On this Ashwani Kumar got infuriated and some altercation took place between them. on 05/07/2008 Suresh Kumar went to street no.6 in New Plot Jammu in connection with some domestic work, he saw all the accused armed with swords, sticks and bricks and all of them armed with deadly weapons attacked him who rushed towards house of one Naresh Kumar S/O Thakur Dass R/O House No. 74 New Plots, Jammu for protecting himself. It has been alleged that the accused made attempt to commit murder of Naresh Kumar. The injured Thakur Dass was taken to GMC hospital, Jammu but he succumbed to the injury while being shifted to hospital. 1st Additional Sessions Judge Jammu MA Choudhary after hearing both the sides observed that prosecution has succeeded to prove its case to bring home the charge for the commission of offences punishable under sections 304-II, 149,147,336,337 RPC. All the accused are thus convicted for the commission of offences punishable under sections 304-II/149/147/336/337 RPC. With these observations Court awarded rigorous imprisonment for 7 years and fine of Rs. 50,000/- each for the commission of offence punishable under section 304-II r/w 149 RPC. |
