Court rejects bail plea to accused in torture death case of woman | | | Early Times Report
Srinagar, Mar 5: A local court has rejected bail application of husband and in-laws of a woman who allegedly forced her to set herself on fire at Khaniyar locality in this summer capital of the state last year. The woman poured kerosene and set herself on fire on 25 October last year, when the people were celebrating Eid festival. She later succumbed to severe burn injuries at a local hospital. However before her death, she gave a statement to the police that her husband, Mohammad Rafiq Sofi and in-laws used to torture her, prosecution said in objections to the bail plea filed by the accused. Besides Mohammad Rafiq Sofi, the other accused include his mother Fatima and two sisters Jameela Akhtar and Saleema Akhtar. Counsel for the accused submitted that all the women were suffering from various ailments and should be released on bail. He said that Saleema was chronic heart patient while Jameela is a suffering from kidney problem and put to dialysis. Fatima, the counsel said, is old aged woman of 70 years of age. He said that all the accused were 'falsely implicated' and should be enlarged on bail. "As three of the accused are women they deserved to be enlarged on bail under provisions of Cr.Pc section 497," the counsel said. After hearing all the parties, court of first Additional Session Judge Srinagar, Madan Lal rejected the bail application, observing that they do not deserve to be enlarged on bail. "It has been found that crime against women is on alarming scale and in case it is not checked it would have far reaching consequences. It is also settled law in non-bailable offences accused person cannot claim bail as a matter of right and it's the discretion given to the court to exercise in judicious manner," the court said. The court said that since the accused persons are alleged to be involved in commission of offence under section 498-A and 306 RPC which is heinous in nature, giving the concession of bail at this juncture would give a wrong signal to the society at large and encouragement of wrongdoers. "It has been seen that the movement a person is arrested in a heinous offence, he takes numerous grounds for seeking bail as in present case the accused persons have taken pleas regarding their ill health," the court said, adding, "It is the duty of the state to take care of its citizens if they are behind the bars and authorities are supposed to give best treatment to them." |
