JAMMU, Mar 8: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today permitted state government to announce amnesty scheme for tax defaulters, permitting them to pay tax with interest in instalments. The court directive came in an application, seeking modification of September 4, 2012 order prohibiting respondents from issuing amnesty scheme for recovering taxes from defaulters, including firms and companies. The bench, after hearing the two sides, allowed the application and ordered government to announce amnesty scheme in exercise of powers under section 25-D of J&K GST Act, 1961, permitting defaulters to pay tax with interest in instalments. The scheme should be for a limited period and the entire tax arrears with interest should be payable by defaulters, the court directed. The bench modified the September 4, 2012 order as one time measure enabling the government to announce amnesty scheme in exercise of powers under section 25-D of J&K GST Act, 1961, permitting defaulters to pay tax with interest in instalments.
