HC stays release of 34 CCRs to Ansari-led JKCA

Srinagar, May 7: The state high court today stayed an order by court of a special judge anti-corruption (CBI cases) in which it had ordered release of credits certificates in favour of Imran Ansari-led faction of JKCA on March 19 this year.
"Impugned order dated March 19, 2016 is stayed till next date of hearing," a bench of Justice Mohammad Yaqoob Mir said and issued a notice to Assistant Solicitor General of India for filing of response. The high court passed the order on a plea of M L Nehru, general secretary of Farooq Abdullahj-led faction of JKCA.
In his contentions, Abdullah-led faction said the association had been held valid by the excise magistrate at Jammu as it was formed in 2014 under JKCA constitution for the period of 3 years which according to the Nehru was yet to expire.
On March 19 , the special judge anti-corruption had passed the order on an application filed Iqbal Ahmad Shah, general secretary of JKCA (Imran Ansari Faction), seeking release of case credit certificates on the ground that in pursuance of alleged misappropriation of funds in JKCA an FIR 27/12 u/s 120-B, 406, 409 RPC was registered at Ram Munshi Bagh police station. He said during the course of investigation, police seized the bank accounts of the association including the CCRs, as a result of which the BCCI stopped all the payments due to the association.
The stoppage of funds, he said, severely affected the affair of the association and that the employees working with the association were without salary for months together.
He said that employees could not afford to bear any further delay in fulfilling their domestic needs and urged that CCRs should be released so that salary was paid to the employees and the same can be utilized for day to day expenses of the cricketing activities in the state.
CBI filed reply to the application, submitting that the FIR has been transferred to the CBI and accordingly case was registered by CBI in New Delhi on September 21, 2015. The case is still under investigation and 34 CCRs got prepared by JKCA against the amount received from BCCI were seized by the police and the CBI has seized the same from SP East. The CBI further submitted that no loan has been raised against these CCRs and no fraud has happened with these CCRs and the proceed of the CCRs is property of JKCA.
"In view of the facts and circumstances of the case the grounds mentioned in the application, detailed reply submitted by CBI and submission made by counsel for the parties at bar in my considered view it will be in the interest of justice and development of cricketing activities in the state of J&K in case 34 CCRs are released in favour of the JKCA, so that the JKCA on the credit to its account as mentioned in the application can pay the salary of its employees and also utilize the same on the development of cricketing activities in the state," the special judge anti-corruption had said.
