Pathania corners Govt over lesser wages to SPOs, ReTs, Daily Wagers | | | Asif Iqbal Naik Srinagar, June 6: BJP MLA from Ram Nagar Udhampur Ranbir Singh Pathania today cornered the government over disparity in wages and the government failure to implement the minimum wages act in the state in support of SPOs, ReT,s, daily wagers and other employees of the state who are getting monthly salaries lesser then the wages fixed in Minimum Wages Act. As per the details available with "Early Times", in A.Q no. 317 of the MLA R S Pathania regarding violation of "Minimum Wages Act", he (Pathania) took the state Government to task for non- payment of minimum wages to SPOs, DRWs, ReTs and other contractual workers engaged by Government. With full pitch and vehemence at his command, Pathania while targeted his own government relied on Article 19 (1) (g) of Indian Constitution and Section 21 of J&K constitution and said that 'Right to Work' and 'Right to Decent wages' is a fundamental right and could not be violated or impugned so easily. Also as per Sec. 22 of Minimum Wages Act, if any private person, institution or establishment omits or denies payment of "Minimum Wages" to its workers there is specified penal punishment with a provision of fine, imprisonment or both under the Act. But at the same time despite constitutional, statutory and legal safeguards, Govt. is the observing Minimum Wages Act in breach and paying less than a minimum wage to SPOs, DRWs, Contractual employees,Safaiwalas etc. Worsemore, PHE daily wagers are without salary since years. In reply Imran Raza Ansari Minister I/c Labour & Employment informed that Minimum wages specified as per SRO-3 dated 04/03/2013,are applicable only to a category of scheduled employment as per Annexure-A to SRO-3 and as such SPOs, ReTs, ReZs, Casual labourers, DRWs, Chowkidars and Lambererdars, Safaiwallas/ Drivers/PTS engaged by Health department and night chowkidars engaged by CAPD do not come under the purview of Minimum Wages Act. Agitated and infuriated by the half hearted and evasive reply from the Minister, Pathania accused the Govt. of adopting a hostile and discriminatory attitude towards its own employees and adopting two yardsticks - one for private employers and other for govt. employees. He further castigated the govt. for denying protection and safeguards of "Labour laws" to its own workforce. Upon repeated interventions, the concerned minister failed to satisfy the agitated member. MLA Pathania repeatedly called for a constructive debate on the issue. MLA Pathania at the end also underscored urgency for a comprehensive revision of the Minimum Wage Policy and legal safeguards in the interest of these classes of Govt. Employees. No employee should be paid lesser than a minimum wage and all legal safeguards as are available to permanent employees should be available to temporary / contractual /daily rated employees. He said that successive Govts. in past have failed to safeguard the interests of this section of employees and with the Youthful and vibrant Chief Minister in the chair he expects that " Justice and Equity" shall swing in favour of unemployed, underemployed and poorly employed youth of Jammu and Kashmir. |
