Agri deptt flouts HC orders with impunity

JAMMU, June 10: The Agriculture Production department has reportedly flouting repeated directions issued by Jammu and Kashmir High Court in favour of implementing order number 279-Agri of 2008 and has been promoting juniors and demoting the seniors as per the order.
In a latest decision pronounced by High Court, the officer promoted as per order 279-Agri of 2008, who was made subordinate to his junior officer, has been directed to work on the post of Chief Agriculture Officer, giving a blow to department.
As per documents in possession of Early Times Sunil Kapahi, who was elevated as Chief Agriculture Officer (CAO) as per government order number 279-Agri of 2008 and was working as Incharge CAO Kishtwar was made Incharge DAO Rajouri according to order number 148-Agri of 2016, and another officer was made Incharge CAO.
"Sunil Kapahi was made DAO and was to work under an officer, who was junior to him as per government order 279", sources said, adding that meanwhile another officer, who was junior to Sunil Kapahi was made CAO Kishtwar, in contempt of High Court directions.
Against the repeated orders of Agriculture department, Sunil Kapahi knocked the door of High Court and on 7 June 2016, HC passed an order in favour of Sunil Kapahi.
The HC order reads as, "It appears the Govt order number 148-Agri of 2016 dated 25/5/2016 to the extent of posting Ramesh Kumar Bhagat Incharge Assistant Agriculture Chemist Jammu as I/C DAO (E) Kishtwar and asking him to look after the charge of CAO, Kishtwar has been issued in ignorance of the interim direction issued by the Court vide order dated 24/5/2016 whereby transfer and posting of petitioner Sunil Kumar Kapahi, I/c CAO Kishtwar as I/c DAO Rajouri has been stayed. In view of the interim direction issued by this court, petitioner Sunil Kumar has to continue as I/c CAO Kishtwar and none else can be posted against the said post, till further orders from the Court."
It further reads, "Meanwhile subject to objections, Govt order number 148-Agri of 2016 dated 25/5/2016 to the extent of giving additional charge of CAO, Kishtwar to Ramesh Kumar Bhagat shall stay and the interim direction issued by this court dated 24/5/2016 be given effect to.".
Sources said that Sunil Kapahi was elevated as CAO according to order number 279-Agri of 2008, dated 7/10/2008, whereas all other officers elevated as per order number 141, 148 and 164 were not elevated as CAO and equivalent as per order 279 of 2008.
"There are half a dozen officers still waiting for their adjustments as CA, who were previously elevated as CAO according to govt order number 279 of 2008", sources said.
