HC directs to appoint petitioner as cop | | | Early Times Report Jammu, Aug 1: High court judge Janak Raj Kotwal today directed respondents to appoint the petitioner as a cop in the executive police pursuant to his selection in the department vide a communication in 2012. The court directive came in a petition filed by one Firhad Ahmad whose selection in police was cancelled as he was allegedly involved in a case. After hearing the two sides, Justice Kotwal observed that the respondents 'cannot be said to have committed any illegality in not issuing the appointment order to the petitioner during the pendency of criminal case against him but the cancellation of selection order altogether merely because of his involvement in the case without even waiting for its disposal was not justified and cannot be held a correct decision'. With these observationds, he allowed the petition and quashed the impugned cancelletion order with a direction to respondents to appoint the petitioner as constable in executive police pursuant to his selection during recruitment vide communication No Pers-DGP-D/OSSR/ Udr/2012/22469-71 dated April 27, 2012 subject to fulfillment of formalities mentioned in clauses (b) to (e) thereof. The petitioner's appointment would be made notionally with effect from June 29, 2013, ie a day after the disposal of the criminal case, without any monetary benefit up to date of his joining. Let the entire exercise completed and this judgment be implemented within six weeks hereafter, the court directed. |
