Court releases SSP Srinagar on bail

Srinagar, Aug 1: A city court today released Senior Superintendent of Police (SSP) Srinagar on bail after he was produced before it by DIG central Kashmir for his failure of not registering an FIR against a DySP in connection with the killing of a 26-year-old youth in Tengpora last month.
As the case came for hearing before the Chief Judicial Magistrate Srinagar, Masarat Shaheen, the SSP Srinagar Amit Kumar filed an application for recalling of non-bailable warrant issued against him by the court on Saturday last.
"As SSP has been produced under proper custody and the warrant has been executed, hence application has already become anfractuous," the court said and granted the bail to the SSP on furnishing the bail and personal bonds of Rs 50000 each.
The police officer also sought time for filing the statement of facts and the court granted him time till Tuesday with a direction to comply with its directions on July 18 and 28 by lodging the FIR against the DySP Yasir Qadri and other policemen who were part of the party that killed the youth.
"File the copy of FIR within 24 hrs, court said, adding, "in case (he) fails to comply the orders of the Court, then rule will be framed against him and same will be referred to High Court for punishing the SSP Srinagar under law," The court also directed the SSP to remain present before it on Tuesday (2 August) along with compliance report.
The CJM passed the orders on an application filed by youth's father, Abdul Rehman Mir, seeking direction to the station house officer (SHO) Batamaloo to file FIR against the Deputy SP under Section 302 (murder) of the RPC.
Meanwhile, the J&K High Court declined government's plea to stay Chief Judicial Magistrate Srinagar's orders to register FIR against a DySP in connection with killing.
"Record can't be called (from CJM)," a bench of Justice Mohammad Yaqoob Mir said in response to the plea by additional advocate general Mohammad Amin Rathore during the hearing a petition by the ruling government against the CJM directions to SSP Srinagar to get FIR registered against the DySP .
"In the present case (FIR no 89/2016) has been lodged of a stone pelting incident and same is under investigation which is conducted on war footing. In addition to it, district Magistrate Srinagar is also conducting an enquiry of the same incident about the circumstances in which death of one person has taken place," he said. The court posted the case on Tuesday.
