HC takes suo-moto notice of mysterious burning of schools | Directs CS, IGP, DSE to unmask enemies of edu | | Early Times Report Srinagar, Oct 31: Pulling up state for remaining in 'deep slumber', the high court today directed the chief secretary, IGP and director school education (DSE), Kashmir, to issue necessary instructions to take all preventive and protective measures as shall be necessary for saving the school buildings from being burnt by the mysterious enemies of education and to ensure that no other school building, in any manner, was harmed or destroyed. More than two dozen schools, mainly government-run, were burnt down under mysterious circumstances in last two months. Taking suo-moto cognizance of media reports, a division bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey also directed the government and police to unmask 'mysterious enemies of education' and deal with them with an iron hand. "Comprehensive and consolidated compliance report be filed by or before November 7, 2016," the court said. The bench observed that the mysterious burning of centres of learning, such as school buildings, had sent shock waves, awakening all to ponder. "Education is the main factor for intellectual excellence and prosperity. Imparting education in the centres of learning has no other viable substitute. Imparting education has an effective impact on all round drawing out of the best in the child and man, body, mind spirit," the court observed, asking can a nation, community or state afford to shun the path of education or bear the loss of mysterious burning and destroying the school buildings? "Everyday there is news item that the school building has been mysteriously burnt. Is it acceptable? Answer is no," the court said, adding that on hearing about such an unfortunate and horrendous episode everybody bleeds. "Alas! Mysterious enemies of education are mysteriously burning schools and institutions. The state administrative authorities are required to resort to protective measures but they are still in deep slumbers," the bench said. The court said that it was the collective responsibility of all to save school buildings. By burning a school building, the court said, a mysterious person might enjoy its flames and smoke but that sadistic enjoyment could be only for an hour or so, least realizing that he is darkening the educational atmosphere. "All concerned at their respective levels and the authorities of the government in particular shall immediately take all necessary measures so as to protect these school buildings," the court said. "The responsibility of the state is to keep the institutions open and then it is the responsibility of the citizens to avail benefit of the same. Whether children will appear in the schools or not, that is the responsibility of the parents but on such ground the state authorities cannot say that they have a difficulty in protecting the school buildings," the bench said. Kashmir's Divisional Commissioner, IGP and DSE, who were present in the court, stated in one voice that there were inherent hardships. They said for providing adequate protection, there were certain difficulties. However, the court expressed its dissatisfaction, observing that it was the responsibility of the state to protect the public property, more particularly the school buildings. "It appears that till now the authorities at various levels have not taken a call by sitting together for devising methods and measures for protecting these schools buildings from being burnt. All the three responsible officers present in the court are directed to sit together with higher authorities and lower officials to devise modes and methods which shall be effective in protecting school institutions," the court ordered. |
