Ban on mining in Tawi: HC directs SSP to file status report

Jammu, Dec 19: In a PIL highlighting illegal mining in Tawi, a high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today directed SSP, Jammu, to file a status report by or before December 21, 2016 as regards the steps taken to enforce of the court directive, banning mining in the river. The SSP appeared in person in the court and produced some orders, prohibiting extraction of minor minerals as well as seizure of vehicles carrying them. It was also submitted that a direction had been given to the SHOs of concerned police stations that no extraction should be permitted between 6 pm to 6 am without prior permission of the authorities concerned. The bench, however, said that no material record in respect of seizure of vehicles and other details was made available. After the SSP sought time to file status report in this regard, the bench granted him two days' time and directed Registry to list the PIL on December 21. The counsel of petitioner drew the court attention towards rampant violation of court directions by the mining mafia and submitted that lower rung police officials in Sidhra area were hand-in-glove with the mining mafia and no effective steps had been taken by police to nab the culprits. He also alleged that lower rung police officers were encouraging night constructions on the river bed for extraneous considerations.
Tractor-trolleys carry illegally extracted minerals during night from the river bed towards the city after crossing police nakas but till date no trolley had been seized. Another counsel submitted that Jammu police were not taking the court directions seriously. They emphasised the need for constituting a high level team to visit the river bed area to find out how the organized mafia was violating the court directions. Despite the presence of a naka near Sidhra bridge, no steps were being taken to stop the movement of tractor-trolleys during night hours, he alleged. He also alleged that despite a ban, malba was being thrown on the river bed. He submitted that senior police officers should be directed to personally monitor the implementation of court directions.(JNF)
