Srinagar, Dec 19: The high court has directed state government to respond to the Supreme Court observation, blaming it for the 'unfortunate situation that has resulted in a large number of persons being recruited on a daily wage basis' in the state's higher and lower judiciary. Earlier this month, SC had set aside the high court order, directing en masse regularization of 209 daily rated workers in high court and subordinate courts. Disposing of an appeal filed by the J&K government, a bench of the apex court, headed by Chief Justice T S Thakur, also pulled up the state for neglecting the requirements of the state judiciary for a long period of time. "Since the issue of regularization is a matter with which the state government is seized, we are of the view that at this stage it would be appropriate and proper to set aside the impugned high court order which directs the regularization of 209 daily rated workers," the bench, also comprising of Justice, Dr D Y Chandrachud and Justice L Nageswara Rao, said. The court had said: "It is unfortunate, in our view, that the state government has allowed the requirements of the state judiciary to be neglected over such a long period of time. The need to facilitate the proper functioning of the high court and district judiciary is a constitutional necessity which imposes a non-negotiable obligation on the state government to create an adequate number of posts and to provide sufficient infrastructure." It said the state government was to blame for the unfortunate situation which had resulted in a large number of persons being recruited on a daily wage basis. A division bench of the high court comprising Justice M H Attar and Justice A M Magrey, while hearing the matter, directed the state government to respond to the apex court observation. "The state government shall also have to respond to the SC observation before the next date of hearing," the court said. It also sought latest compliance report from the authorities about the present stage of construction of District Court Complex, Srinagar, and Additional District Court Block, Anantnag, by the next date of hearing. |
